This dissertation is the first step in a larger research project aimed at bridging the gap between Western philosophy and Indigenous thought. Here, I identify a useful methodological approach to the social contract by analyzing the tradition under an historical lens. I highlight that, along with the justificatory capacities of the social contract, comes a great deal of modelling involved in different versions of the social contract. This modelling comes in the form of four pre-contractual elements that different authors model (...) in different ways. I show how different authors choose different structural problems or injustices that such theories want to address, as well as normative commitments that their theories are committed to, a standard of considerability of interests that identifies whose interests matter for those deliberating the terms of the contract, and a contractual device. Once that has been established, I am able to provide some foundational elements for establishing a framework for the development of a theory of global justice. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Transcranial Magnetic Stimulation (TMS) is a non-invasive neurostimulatory and neuromodulatory technique increasingly used in clinical and research practices around the world. Historically, the ethical considerations guiding the therapeutic practice of TMS were largely concerned with aspects of subject safety in clinical trials. While safety remains of paramount importance, the recent US Food and Drug Administration approval of the Neuronetics NeuroStar TMS device for the treatment of specific medication-resistant depression has raised a number of additional ethical concerns, including marketing, off-label use (...) and technician certification. This article provides an overview of the history of TMS and highlights the ethical questions that are likely arise as the therapeutic use of TMS continues to expand. (shrink)

Pablo, como hacía siempre, se implicó hasta el tuétano con nosotros, nos mostró su pulsión obsesiva por la perfección, nos dejó no ya sus trabajos personales, sino también el compromiso con la revista y su enfoque fenomenológico de estos años: urdiendo números especiales que lo agotaban por esa exigencia extrema y el control que ejercía hasta el final (...) y más allá. Es este trabajo inagotable el que aupó, entre otros naturalmente, nuestra revista a un rango insospechado… Pero dicho esto, Pablo se me presenta hoy, debido a su juventud, a su brusca desaparición, como un enigma. ABSTRACT This paper aims to offer both an interpretation and a critique of the epistemological foundations underlying one of the most recent approaches to trauma studies: cultural trauma theory. After the First World War, the founding father of psychoanalysis, Sigmund Freud, inquired into whether his diagnostic of “traumatic neurosis” could shed light on how collectives deal with unsettling experiences and memories. Throughout the intervening decades, Freud´s insights into collective trauma have attracted the interest of scholars from various disciplines within the (...) humanities and social sciences, from literary studies to historiography, memory studies, and, finally – the focus of this paper – cultural and social theory. By underlining the ways in which the proponents of cultural trauma theory – Jeffrey Alexander, Neil Smelzer, Piotr Sztompka, Bernhard Giesen, and Ron Eyerman – have reframed Freudian ideas regarding the transmission of legacies of collective suffering, the paper considers whether the notion of trauma can be extended to the analysis of cultures and societies. It explores the ambivalent relationship between psychoanalysis and contemporary cultural trauma theory to disclose the theoretical assumptions and weaknesses of the latter. (shrink)

Este artículo propone una exploración de los textos compilados en Marginales de la Vida (1963), título publicado por el salvadoreño Arturo Ambrogi en 1912, a partir de los vínculos que se establecen en ellos entre la influencia de la estética modernista y el oficio periodístico practicado por el autor. Los objetivos centrales son aproximarse a la producción literaria de Arturo Ambrogi mediante un análisis de las tensiones generadas al momento de ubicar parte de su escritura dentro de la literatura salvadoreña, (...) centroamericana y latinoamericana de principios del siglo XX, a la vez que se postula la posible existencia de un híbrido literario que rehuyó en gran medida de los puntos de vista seguidos por otros autores contemporáneos de la región durante la época en estudio. En 1968 leíamos a Sartre y a Camus y, entre nosotros, Unamuno y Ortega se mezclaban con la poesía de Miguel Hernández o Blas de Otero, y las películas de Bergman. Vivir en la periferia, entonces, tenía limitaciones que el tiempo no subsana. Internet es hoy una posibilidad, cierto, pero también encubre, mistifica, mantiene a la conciencias individuales en su atomicidad sedente. Es su función ideológica y política, mientras se incrementan aquellas limitaciones. Aquella periferia tenía, al menos, la excusa de (...) la ‘dictadura’. Eran tiempos de lecturas frenéticas y de emociones intensas pero «vacías», sin horizontes ni concepto. Había otras ciudades, otros jóvenes, incluso entre nosotros. Había ya quienes se agrupaban, quienes leían a Marx, quienes viajaban y, sobre todo, quienes sufrían. (shrink)

El hallazgo zambraniano de la razón poética no solo descubre la escisión de la poesía en la razón ni la imposibilidad de un método universal que las articule nuevamente, sino que revela también esa ruptura en el ámbito educativo así como posibles caminos de reencuentro entre ambas. Es necesaria una educación que se haga cargo de la vida, que no la deje al margen, que no la anule frente a lo establecido, las dinámicas del mercado o los poderes imperantes. Si bien una parte de los proponentes de esta teoría de la democracia asimilaron el esquema tradicional que reducía la sociedad civil a la esfera privada, otros han sabido ir más allá y la han situado en un lugar privilegiado dentro de la esfera pública. We live in an era where our health is linked to that of others across the globe, and nothing brings this home better than the specter of a pandemic. This paper explores the findings of town hall meetings associated with the Canadian Program of Research on Ethics in a Pandemic , in which focus groups met to discuss issues related to the global governance of an influenza pandemic. Two competing discourses were found to be at work: the first was based (...) upon an economic rationality and the second upon a humanitarian rationality. The implications for public support and the long-term sustainability of new global norms, networks, and regulations in global public health are discussed. (shrink)

This paper argues for a broad definition of philosophical sources and how Indigenous traditional knowledge fits that definition. It concludes by showing how, following the previous two points, an Indigenous document such as the Huarochirí Manuscript can be considered a philosophical source by academic philosophers. The paper has three sections: the first deals with the methodological point of addressing what can be considered as philosophy. This section presents a conversational approach to philosophy. This approach, although broad, properly captures the practices (...) of inquiring about philosophical issues as is commonly done in Western academic circles, but without excluding the practices of non-Western cultures from being labelled as philosophical. The second section argues for the analytical distinction between a philosophical source, a philosophical text, and a philosophical insight. It shows that what makes a philosophical source such are the philosophical insights that it can provide. The final section shows how the Huarochirí Manuscript has merits making it worthy of being considered a philosophical source and thus a relevant academic source for those working in the field of philosophy. Le but de cet article est d'interroger les transformations culturelles qui accompagnent la commercialisation des inventions, phénomène majeur de l'essor marchand et consumériste au XVIIIe siècle. Les stratégies commerciales des inventeurs sont fondées sur une médiatisation croissante, mêlant rhétoriques visuelles (démonstrations, spectacles, expositions) et recours à l'imprimé: annonces de presse, affiches, prospectus, modes d'emploi, livrets d'utilisation. L'information et le savoir techniques jouent un rôle clef dans la construction de marchés pour les inventions. Cette dimension a rarement été prise en compte (...) dans l'histoire de la consommation et dans l'histoire des techniques. Pourtant, la littérature d'usage, qui postule l'autonomie et la capacité participative de l'acheteur comme argument de vente, exprime la montée en puissance des savoirs d'action, opératoires, prescriptifs, où priment le verbe et le geste, l'intention et le projet. Si la technologie des Lumières se déploie dans les traités et les dictionnaires, elle se manifeste aussi dans cette littérature éphémère, pratique et commerciale, source d'appropriations. (shrink)
